Privacy Policy

§1

General provisions

1. This Privacy Policy defines the way in which personal data is collected, processed and stored for Users of the Online Shop available at the domain sobczukbags.com

2. The administrator of the personal data is the operator of the Online Shop sobczukbags.com (hereinafter: Online Shop) Karol Sobczuk Leather Goods, Ul. Plac Sikoraskiego 8/1, 18-300 Zambrów, Poland

3. Personal data is processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation).

4. The data collected by the Administrator will be:

- processed in accordance with the law,

- collected for specified, legitimate purposes and not subjected to further processing incompatible with those purposes,

- Substantially correct and adequate in relation to the purposes for which they are processed,

- stored for no longer than is necessary to achieve the purpose of the processing.

Scope of data collection

1. The controller processes personal data necessary for the provision and development of the services available on the

Online shop.

2. The scope of the data collected is adequate for the purposes for which it is collected (indicated in §3 point 1

Policy). In particular, this is: name, e-mail address, mailing address, number

telephone.

Aims and legal bases of data processing

1. Personal data of Users and Partners may be processed for the following purposes:

a. account registration and verification of the User's identity - on the basis of acceptance of the terms and conditions

Regulations (Article 6(1)(b) RODO),

b. take pre-contractual action at your request and perform the contract concluded

sales, including the handling of payments and the delivery of goods (Article 6(1)(b) RODO),

c. make online purchases without or with registration of a user account, including the execution of

online payment and delivery of goods (Article 6(1)(b) RODO)

d. to comply with the Administrator's legal obligations relating to accounting and

taxes and for archiving purposes (Article 6(1)(c) RODO),

e. the sending of newsletter marketing content, based on voluntary consent

User (Article 6(1)(a) RODO) ,

f. communication with the User via the contact form available on the site, on the basis of

legitimate interest of the controller (Article 6(1)(f) RODO),

g. asserting or defending against claims, which constitutes a legitimate interest

Administrator (Article 6(1)(f) RODO).

2. In each of the above-mentioned cases (§3 para. 1), the provision of data is voluntary, however

necessary for the conclusion of a contract or the use of other functionalities available in the Shop

Internet.

Invitations to review

  1. With the completion of your order and acceptance of the terms and conditions, we may send you an email inviting you to give a review of the product or service you have purchased.
  2. These messages are sent on the basis of our legitimate interest in accordance with Article 6(1)(f) of the RODO (in the European Union) or as part of permitted marketing communications in accordance with applicable legislation (e.g. CCPA in the United States).
  3. In some cases, depending on local regulations, we may require explicit consent to receive invitations to review. If consent is required, this will be obtained during the ordering process via the relevant checkbox.
  4. You have the right to withdraw your consent or object to receiving such messages at any time. He or she may do so by contacting us or by clicking the appropriate opt-out link included in the email.
  5. Sent invitations to review may be carried out both directly by us and by external partner platforms for the collection of reviews. In such cases, the processing of data takes place under the terms of our Privacy Policy.

    Consent to use of image in customer reviews

    1. voluntariness of consent 

       The customer who chooses to submit an opinion along with a photo or video recording, voluntarily consents to the publication of his/her image for promotional and marketing purposes on the sobczukbags.com website, in social media (e.g. Instagram, Facebook) and in other advertising materials.  

     

    2 Scope of use

     

       An opinion, photo or video may be published on:

       - website sobczukbags.com

       - social media run by the company Karol Sobczuk Leather Goods

       - promotional materials, including marketing emails and advertisements.  

     

    3 Duration of consent

       Consent is granted for an indefinite period of time, but the customer has the right to withdraw it at any time by contacting us by email at kontakt@sobczukbags.com. Once consent has been withdrawn, we will remove material containing the customer's image as soon as possible.  

     

    4 Customer rights

       The customer has the right to:  

       - access to their data (including submitted opinions, photos and recordings),  

       - request their removal,  

       - to restrict their processing,  

       - withdraw consent without affecting the lawfulness of processing carried out before consent was withdrawn.

Period of processing of personal data

1. Personal data will be processed for as long as the person remains an active user

the Online Shop, and thereafter for the period necessary to comply with the provisions of the

the right, exercise or defence of any claim, but not more than 6 years from

the date of termination of the contract for the provision of electronic services (in the case of Users with a registered account on the site) or making the last purchase (in the case of Users

making purchases without registration).

2. Data processed for the purpose of sending marketing information will be processed until

to withdraw the consent given, provided that the withdrawal of that consent shall not affect the compatibility of

processing that was carried out prior to this withdrawal.

Recipients of data

1. Personal data may be disclosed:

a. Administrator's partners,

b. Internet payment operators,

c. to courier and postal services providers,

d. law firms,

e. subcontractors, in particular entities supplying and operating selected systems and

IT solutions.

Rights of data subjects

1. The user of the service is entitled in particular to

a. to have access to the content of their personal data processed by the Controller,

b. rectification of data,

c. deletion of data,

d. restriction of data processing,

e. data portability,

f. to object to processing carried out on the basis of a legitimate interest of the controller,

g. withdraw consent at any time without affecting the lawfulness of the processing carried out on the basis of that consent prior to its withdrawal,

2. The data subject has the right to lodge a complaint with the President of the Data Protection Authority

The Commission will notify the Personal Data Protection Officer if it considers that the processing infringes its rights or freedoms, in particular under the RODO.

3. If the data subject has any doubts as to how his or her rights are to be exercised or wishes to make a request with a demand as referred to in §6(1), he or she may at any time contact the Controller at the address: kontakt@sobczukbags.com

Final provisions

1. No automated decision-making including profiling takes place in the processing of personal data.

2. The Administrator reserves the right to make changes to this Privacy Policy, while ensuring that the rights of individuals under this document are not restricted without their consent.

As of 1 January 2021, new consumer law provisions came into effect. Self-employed individuals who make a purchase from an online shop or from a stationary shop, even though they take an invoice, will in some cases have rights like those of a consumer. This applies in particular to returns and complaints. Sellers will additionally have to comply with a number of information obligations in relation to sole traders.

The changes apply to online sales, stationary sales, orders placed by telephone or email.
